DISCLAIMER: Tolba facilitates the exchange of verified Guardian contact numbers solely for the purpose of traditional, family-oriented marriage introductions. Once a Guardian’s telephone number has been disclosed and communication moves beyond the Platform, Tolba bears no responsibility or liability for any interactions, agreements, conduct, or consequences that may arise between the parties.

The Platform strictly upholds the cultural and social values of our community and does not endorse, encourage, or enable any behavior that goes against those traditions and morals. All Users remain fully accountable for their actions.

1.Introduction and General Provisions

1. These Terms and Conditions, herein referred to as ("Terms") govern your access and use of the Tolba Platform, herein referred to as ("Tolba" or "Platform" or "We" or "Us"), operated and managed by Authenticity and Modernity for Information Technology LLC (شركة الأصالة والمعاصرة لتكنولوجيا المعلومات ذ.م.م), registered under number 75739, located at Queen Noor Street, Housing Bank Complex, Building No. 93, Office 102, Shmeisani, Amman, Hashemite Kingdom of Jordan.
2. By registering, using, accessing, or browsing the Platform or any associated services, you ("User" or "You" or "Member") explicitly agree to enter into a legally binding contract with Authenticity and Modernity for Information Technology LLC (شركة الأصالة والمعاصرة لتكنولوجيا المعلومات ذ.م.م). Your use constitutes full acceptance of these Terms.
3. The Tolba Platform is intended solely for traditional marriage matchmaking, in alignment with the cultural and social values upheld in our region. It enables communication between men genuinely seeking marriage and the guardians of women who have willingly shared their guardian’s contact information, strictly for the purpose of traditional marriage.
4. Tolba reserve the right to amend, update, or change these Terms at any time. Your continued use of the Platform after any amendment constitutes your acceptance of such changes.

2.Definitions

The following terms shall have the meanings set forth below:

1. “Company”: Authenticity and Modernity for Information Technology LLC (شركة الأصالة والمعاصرة لتكنولوجيا المعلومات ذ.م.م), registered under no. 75739 with the Companies Control Department – Limited Liability Companies Division at the Ministry of Industry and Trade. The company is the owner and operator of the Platform.
2. "Platform": Collectively, the Tolba mobile applications (iOS, Android), website, sub‑domains, back‑end services, databases, algorithms, and any features, content, or technology made available by or on behalf of the Company.
3. "User" or "Member": Any natural person who creates an Account on the Platform, whether a male or female.
4. "Guardian": The female Member’s mother or legal guardian whose contact information is provided by the female Member for matchmaking purposes.
5. "Subscriber": A Member who has purchased and maintains an active, fee-based subscription on the Platform.
6. "Account": The registered profile created by a User on the Platform.
7. "Matching": The process where a male Member expresses interest in a female Member’s profile, and upon acceptance from the female Member, receives contact details of the Guardian to facilitate traditional matchmaking.
8. "OTP Verification": A one-time password verification procedure sent to the users and Female’s Guardian registered phone number to validate authenticity.
9. "Subscription Package": A fee-based plan offered by the Platform that, once purchased, grants a Subscriber the specific access rights and privileges applicable to that Subscriber’s user category during the active subscription term.
10. "Communication Credit": Units purchased within Subscription Packages, each enabling the Subscriber to obtain the Guardian’s phone number upon successful matching.

3.User Eligibility and Registration

1.  Users must be at least 18 years old at the time of registration. By registering, Users explicitly affirm compliance with this requirement.
2.  Users must provide accurate, truthful, and complete information during registration. False, misleading, or incomplete information constitutes grounds for immediate suspension or termination of the Account.
3. Users are permitted only one Account per individual. Multiple Accounts are strictly prohibited and may lead to termination of all related Accounts without prior notice.
4. Female Users must provide accurate and verifiable Guardian contact information. An OTP will be sent to the Guardian’s phone number provided to ensure authenticity. Female Users consent explicitly to the use and sharing of their Guardian’s phone number with Subscribers upon successful matching.
5. Users must keep their login credentials confidential and notify us immediately in case of any unauthorized access or security breach.

4.Guardian Contact Mechanism

1. Female Users explicitly consent and affirm that the Guardian’s contact number provided is genuine and belongs to their mother or lawful guardian.
2. After registration, an OTP is sent to verify the member’s contact number and the Female’s Guardian contact numbers. Verification completion is mandatory to finalize female Member registration.
3.  Upon successful mutual matching, the male Subscriber will receive the Guardian’s verified phone number to arrange traditional marriage meetings BEYOND THE PLATFORM.
4. The User bears sole responsibility for ensuring the accuracy of the Guardian’s contact information.
5. Tolba Platform assumes no responsibility for any incorrect, misleading, fraudulent, or disconnected Guardian numbers. Liability for misuse or incorrect information provided lies exclusively with the User.

5.Account and Subscription Policy

1. Female Users are required to purchase Subscription Packages and maintain an active monthly subscription in order to create, display, and keep their profiles eligible for Matching.
2. Male Users shall purchase Subscription Packages to gain Communication Credits necessary to contact Guardians. Each Communication Credit enables the Subscriber to access one verified Guardian’s contact number upon mutual matching.
3. Subscription becomes active 24 hours upon successful payment processing. All payments are final and non-refundable.
4. Subscription payments are processed via secure payment gateways presented by the Platform. Users are responsible for any additional bank or payment gateway fees incurred during transactions.
5. In case of subscription payment failures or errors, Subscribers must promptly contact Platform support for assistance. We will assist Users to resolve payment issues at no additional cost.
6. Subscribers may cancel their active subscription at any time, cancellation becomes effective directly regardless of the completion of the current billing cycle. As expressly provided in the Cancellation & Refund Policy, subscription fees already paid are non-refundable, and cancelled subscriptions do not accrue partial-period credits.
7. Users may voluntarily close their accounts at any time through the account settings on the Platform. Upon closure, data retention policies apply as outlined in Clause 11 of these Terms.
8. Upon voluntary closure or termination as set forth herein, all User access to account information and communication services ceases immediately. Communication Credits, subscriptions, and associated services will not be refunded.

6.Communication Policy

1. Subscribers are strictly permitted to use Guardian contact information for the sole purpose of traditional marriage arrangements.
2. Direct communication between male Members and female Members outside the presence or consent of the Guardian is strictly prohibited and may result in immediate suspension or termination without refund if reported.
3. Use of Guardian numbers or any contact information obtained via the Platform for harassment, fraud, marketing, unsolicited communications, or any unlawful purpose is strictly prohibited.

7.User Conduct and Obligations

1. Users shall act in a respectful and lawful manners at all times, in accordance with the Jordanian customs, traditions, moral values, and applicable laws.
2. Users are strictly prohibited from engaging in, facilitating, or attempting any of the following activities in connection with the Platform:
3. Providing false or misleading information, including but not limited to personal data, marital status, financial capacity, or the Guardian’s phone number.
4. Using an inappropriate profile picture or nickname, such as; images that are explicit, suggestive, deceptive, or culturally offensive, or images of anyone other than the User (including minors or public figures), using nicknames containing profanity, discriminatory language, sexual insinuation, or impersonation of another person.
5. Bypassing the Guardian communication channel, including but not limited to; by searching for or contacting a matched female Member outside the Platform (e.g., through social media) either before or after communicating through the verified Guardian’s number provided by the Platform.
6. Harassment, threats, abusive language, fraud, spam, advertising, or solicitation of any kind.
7. Creating more than one account per individual, allowing others to use it on the User’s behalf or for their personal use, or transferring an account to another person.
8. Using the Platform for commercial, promotional, or data‑harvesting purposes, including scraping, reverse‑engineering, penetration testing, or any unauthorized security testing.
9. Engaging in any activity that violates applicable Jordanian laws, public order, or morality.
10. Tolba reserves the right to suspend or terminate any account immediately and without refund of Subscription fees or Communication Credits if the User commits, assists, or attempts any prohibited activity, in addition to Tolba’s right to pursue further legal remedies where appropriate.

8.Payment, Billing, and Refund Policy

1. Payments for subscription packages are processed through secure payment gateways presented by the Tolba Platform.
2. Subscribers authorize us to charge their selected payment method upon subscription purchase.
3. Subscribers must provide accurate and valid billing information. It is the Subscriber's responsibility to promptly update billing details upon any changes.
4. Subscription prices and packages are clearly outlined within the Platform. Tolba reserves the right to change pricing, packages at any time without prior notice, effective immediately upon posting on the Platform and/or notification.
5. Payments made for subscriptions or communication credits are generally non-refundable once the subscription or credits are activated and available for use. 
6. Refunds or redemption of one (1) Communication Credit may be considered solely in specific cases of verified fraudulent or incorrect Guardian contact information, including but not limited to; Guardian’s phone number is disconnected or permanently unreachable, or Guardian’s phone number does not belong to the designated Guardian or was provided fraudulently by the female User.
7. Refund requests are evaluated case-by-case at the sole discretion of Tolba Platform administration. Subscribers shall provide adequate proof (e.g., call logs, screenshots) to support refund claims.

9.Reporting & Moderation

1. Users shall immediately report any suspected fraud, harassment, misuse of Guardian details, technical vulnerabilities, or other breach of these Terms. Reports may be submitted through the Platform’s reporting features or by contacting support.
2. Tolba will acknowledge a report within one (1) business day and open a preliminary review within forty-eight (48) hours. All information supplied is treated as confidential and disclosed only to personnel or authorities strictly necessary for investigation under Jordanian laws.
3. Complainants and accused Users may be asked to provide screenshots, call logs, or comparable proof. Failure to cooperate can delay or compromise the investigation.
4. If any of the violations mentioned below is substantiated three (3) separate times against the same account, the account will be suspended.:
5. Using an inappropriate or offensive profile picture.
6. Guardian uncooperative or deliberately obstructive behavior after a match.
7. Guardian unreachable or non‑responsive after reasonable attempts
8. Harassment, intimidation, stalking, or other inappropriate behavior.
9. Lack of seriousness (e.g., repeated matching then disengaging).
10. Upon review of any complaint, Tolba reserves the right to take one or more of the following actions:
11. dismiss the complaint;
12. issue a formal warning to the user;
13. restore one (1) Communication Credit in cases where the guardian's number is confirmed to be invalid, disconnected, or fraudulently submitted;
14. temporarily suspend the user’s account for a defined period; or
15. permanently terminate the user’s account.
16. Users who knowingly submit false, malicious, or misleading reports may be subject to similar disciplinary action, including warnings, temporary suspension, or permanent account termination. In such cases, all related fees or credits may be forfeited, without refund.
17. Tolba reserves the right to bypass the abovementioned three‑strike system and impose immediate permanent termination and/or notify law enforcement where conduct involves marketing, immorality, fraud, threats of violence, solicitation of money, or comparable criminal behavior.
18. Nothing in this Clause limits Tolba’ overarching discretion to take any action it deems necessary to protect the Platform or its Users, nor its right to cooperate fully with competent Jordanian Governmental bodies when required or reasonably believed necessary for safety, legal compliance, or enforcement of rights.

10.Liability Limitations and Disclaimers

1. Users are solely responsible for the truthfulness, accuracy, and legality of all information they provide, including Guardian phone numbers. Tolba does not independently verify user‑supplied data and offers no warranty—express or implied—as to its authenticity, completeness, or suitability for any purpose.
2. The Platform, its content, and all related services are provided on an “as‑is” and “as‑available” basis, without warranties of any kind. To the fullest extent permitted under the laws of the Hashemite Kingdom of Jordan, Tolba expressly disclaims all implied warranties of merchantability, fitness for a particular purpose, non‑infringement, and uninterrupted availability.
3. In no event will Tolba, its owners, directors, employees, personnel or affiliates be liable for direct and/or indirect, damages arising out of or relating to: 1) a User reliance on, or use or misuse of, any information obtained through the Platform; 2) Outcomes of communications enabled by Guardian contact details, including courtship, engagement, marriage, or any subsequent dispute; 
4. Tolba is not responsible for, and disclaims any liability arising from, the acts or omissions of Users or third parties; including fraud, harassment, defamation, or any physical or emotional harm resulting from interactions that occur on or because of the Platform.
5. Tolba shall not be liable for interruptions, delays, data loss, or service degradation caused by events beyond its reasonable control, including but not limited to; Internet or telecom failures, power outages, payment‑gateway downtime, cyberattacks, governmental actions, natural disasters, or any event of force majeure.
6. Users agree to indemnify and hold harmless Tolba, its owners, directors, employees, or affiliates against any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising out of: a. User breach of these Terms; b. User‑provided information that is inaccurate, unlawful, or infringes upon the rights of third parties; or c. Interactions between Users not facilitated by/on the Platform.
7. Nothing in this clause limits or excludes any liability that cannot be limited or excluded under applicable Jordanian law

11.Data Protection, Confidentiality, and Retention

1. Tolba processes personal data in strict accordance with the Jordanian Constitution, the Cybercrimes Law No. 17 of 2023, the Telecommunications Law No. 13 of 1995, Personal Data Protection Law (PDPL) No. 24 of 2023 and any amendments thereto or any successor legislation to the mentioned legislations, and any relevant executive regulations. Processing is limited to legitimate purposes based on but not limited to: (a) explicit consent, (b) performance of a contract, (c) compliance with a legal obligation, or (d) Tolba’ legitimate interest in maintaining a safe and effective Platform.
2. All personal data are stored using industry‑standard, with periodic security audits. Access is restricted to authorized personnel bound by written confidentiality undertakings. In the event of a personal‑data breach likely to affect User rights, Tolba will notify both the competent Jordanian authority and affected Users without undue delay.
3. Subject to Personal Data Protection Law No. 24 of 2023, Users may at any time: a) request confirmation of whether personal data are held or not; b) obtain a copy of their held data; c) request correction of inaccurate or incomplete data; d) withdraw consent for non‑essential processing; or (vi) object to direct marketing. Requests should be sent to [privacy@tolba.world] and will be answered within thirty (30) days.
4. Where storage or processing occurs outside the Hashemite Kingdom of Jordan, Tolba ensures the receiving jurisdiction affords an equivalent level of protection through contractual safeguards or other recognized legal mechanisms.
5. The Platform is strictly limited to individuals eighteen (18) years and older. Tolba does not knowingly collect personal data relating to minors; any such data discovered will be deleted immediately.
6. Nothing in this clause restricts Tolba from retaining or disclosing personal data where required to comply with a binding order of a competent court or regulatory body in the Hashemite Kingdom of Jordan.

12.Intellectual Property Rights

1. All components of the Tolba Platform, including but not limited to the mobile applications, website, source code, object code, databases, algorithms, text, photographs, graphics, user‑interface design, compilations, and the “TOLBA” name and logo are the sole and exclusive property of Authenticity and Modernity for Information Technology LLC or its licensors. These materials are protected under Jordanian laws, and international intellectual‑property treaties. All rights not expressly granted to Users in these Terms are hereby reserved.
2. Subject to continued compliance with these Terms, Tolba grants each User a revocable, non‑exclusive, non‑transferable, and non‑sublicensable licence to access and use the Platform for its intended personal, non‑commercial purpose. No other rights, express or implied, are granted.
3. Without Tolba’ prior written consent, Users must not:
4.  Copy, reproduce, distribute, transmit, publish, display publicly, perform, or broadcast any portion of the Platform or its content;
5. Modify, translate, adapt, reverse‑engineer, decompile, or disassemble any software or other elements of the Platform;
6. Create derivative works based on the Platform content or underlying code;
7. Use trademarks, trade names, or logos appearing on the Platform in any advertising or publicity, or register confusingly similar marks;
8. Data‑mine, scrape, or use automated tools to extract or compile data or content from the Platform;
9. Tolba reserves all legal remedies to enforce its intellectual‑property rights, including injunctive relief, statutory damages, and recovery of legal fees under applicable Jordanian law.

13.Governing Law and Jurisdiction

1. These Terms, their interpretation, and any dispute arising from or in connection with the Platform or its use are governed solely by the laws of the Hashemite Kingdom of Jordan, without regard to conflict‑of‑laws principles.
2. Any disputes arising from or related to these Terms or Platform usage shall be subject exclusively to the jurisdiction of the courts of Central Amman (Qasr Al-Adl).

14.Miscellaneous

1. If any provision of these Terms is held invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible, and the remaining provisions shall continue in full force and effect.
2. These Terms including Tolba Privacy Policy and any other policies of the Platform constitute the entire agreement between Users and Authenticity and Modernity for Information Technology LLC (شركة الأصالة والمعاصرة لتكنولوجيا المعلومات ذ.م.م) concerning the Tolba Platform.
3. Users may not assign, delegate, or transfer their rights or obligations under these Terms.
4. Clauses related to intellectual‑property provisions, limitation of liability, indemnity, governing law, dispute resolution, and data‑retention obligations shall survive termination and shall remain in effect after any termination or deletion of a User’s account or these Terms.
